Platform information

Knalveilingen.com acts as a seller or intermediary between buyer and affiliated partners.

Article 1. Definitions

User: Any natural or legal person who uses the website.

User account: Personal login providing access to the website.

Buyer: The user who wins a lot via an auction or purchases a product via the outlet.

Seller: Knalveilingen.com itself or an affiliated partner offering products via the platform.

Platform: Knalveilingen.com, registered at Middachtendreef 12, 5709 RW Helmond, the Netherlands (Chamber of Commerce 83610197, VAT NL003847742B74).

Auction: Online sales process in which bids are placed.

Outlet: Sales environment where products are offered at a fixed price.

Lot: One or more goods, or an experience, offered via the Platform.

Bid: Exclusive of VAT and buyer's commission.

Buyer's commission: 4.99% exclusive of VAT.

Purchase agreement: Formed upon award of a lot or purchase.

Partner Agreement: The additional, individual marketplace partner agreement that Knalveilingen.com concludes with an affiliated partner (Seller), as further described in Article 22.

Article 2. Applicability

These terms apply to all services and transactions.

By using the platform, the user agrees to these terms.

Deviations are only valid if confirmed in writing.

Article 3. Registration and use

Participation requires an account and a minimum age of 18.

The user is responsible for use of the account and must immediately report loss or misuse of login details to Knalveilingen.com.

Knalveilingen.com may block accounts, refuse participation or exclude users.

Knalveilingen.com may require identification or verification.

Article 4. Platform function

Knalveilingen.com acts as a seller or intermediary.

The seller of each lot is indicated per listing.

For partner listings, the agreement is formed directly between buyer and seller.

Payments are processed via a payment provider and may be held temporarily.

Article 5. Auction process

Knalveilingen.com determines how auctions run.

The platform may set bid increments, refuse bids and change or cancel auctions.

A bid placed in the final 30 seconds automatically extends the auction (repeatable).

Bids are binding and irrevocable.

The highest bidder is obliged to complete the purchase.

Lots are sold 'as is'.

Obvious errors (for example, a clearly incorrect starting price) do not bind the platform.

Bids may be declared void in cases of fraud or misuse.

Article 6. Bids, costs and buyer's commission

Bids are exclusive of VAT and buyer's commission.

Buyer's commission is 4.99% (excl. VAT).

Placing a bid itself is, and always will be, completely free, regardless of how often you bid or are outbid — you do not need bid credits, bid packages or a subscription. Buyer's commission and VAT are owed only by the buyer who actually wins the lot, and are always shown before a bid is confirmed.

Total price = bid + commission + VAT + any additional costs.

The platform displays a real-time price indication.

By bidding, the user accepts all associated costs.

No rights can be derived from calculation errors.

Article 7. Outlet

Fixed-price sale; the purchase agreement is formed directly upon payment.

The right of withdrawal applies where legally required (see Article 13).

Unless a different delivery time is stated for the product, Knalveilingen.com or the relevant partner will deliver the purchased product within 30 days of purchase, in accordance with the statutory provisions of Article 7:9a of the Dutch Civil Code. If this term is not met, the buyer may terminate the agreement free of charge.

Article 8. Payment

Payment via the offered methods.

Auction: payment within 48 hours. Outlet: pay directly.

Non-payment may result in termination, exclusion and a claim for damages.

Set-off or suspension of payment is not permitted.

Article 9. Delivery and ownership

Delivery via shipping or pickup.

Risk transfers upon delivery or pickup.

Ownership only transfers after payment in full.

Costs may be charged for late pickup.

Where the seller arranges shipping, responsibility lies with the seller.

Article 10. Warranty and conformity

For purchases via the outlet, the statutory conformity warranty under Article 7:17 of the Dutch Civil Code applies: the delivered product must conform to the agreement.

Lots purchased via an auction are sold 'as is' (see Article 5); the statutory conformity warranty does not apply to these in full, unless mandatory law provides otherwise.

Complaints about a defect must be reported to customer service as soon as possible, and no later than two (2) months after discovery.

Article 11. Sellers (partners)

Sellers are responsible for accurate information, compliance with legislation and delivery.

In the event of non-delivery, the agreement may be terminated and refunded, and Knalveilingen.com may seek recourse against the seller.

Payout follows completion of the transaction.

Poor performance may lead to exclusion.

Affiliated partners are additionally bound by the arrangements set out in the Partner Agreement — see Article 22.

Article 12. Liability

No liability for the conduct of sellers, product quality, or transport by third parties.

No guarantee of error-free operation of the platform; no liability for outages.

Liability is limited to the amount paid, except in cases of intent or deliberate recklessness on the part of Knalveilingen.com.

Article 13. Right of withdrawal

1. For purchases via the outlet and for lots won via an auction, consumers have a statutory cooling-off period of 14 days after receipt of the product. An online auction from a business to a consumer does not fall under the statutory exception for public (physical) auctions, so the right of withdrawal also applies to won auction lots.
2. Within this period, the consumer may terminate the agreement without giving any reason.
3. The right of withdrawal does not apply to:
   • custom-made or personalised products
   • experiences with a fixed date, once the service has commenced
   • products that cannot be returned for hygiene reasons once the seal has been broken
4. The cost of returning the product is borne by the buyer, unless stated otherwise.
5. Refunds are made within 14 days of receipt of the returned product, provided the return conditions have been met.

Article 14. Fraud and misuse

1. It is prohibited to:
   • place false or misleading bids
   • engage in price manipulation
   • use multiple accounts to improperly influence auctions
2. Knalveilingen.com may cancel bids, block accounts, terminate transactions and recover damages.
3. In the event of suspected fraud, Knalveilingen.com may share data with the competent authorities.

Article 15. Complaints and dispute resolution

1. Complaints must be reported to customer service within a reasonable time after discovery.
2. The complaint must be described fully and clearly.
3. Knalveilingen.com aims to handle complaints within 14 days.
4. If more time is needed, the user will be informed of the expected timeframe.
5. Disputes between buyer and seller are first resolved between the parties themselves; Knalveilingen.com may mediate but is not obliged to do so.
6. Consumers within the European Union may also submit a dispute to the European Commission's Online Dispute Resolution platform via ec.europa.eu/consumers/odr.

Article 16. Force majeure

1. Force majeure means any circumstance beyond the will and control of Knalveilingen.com.
2. This includes, among other things, outages, transport problems, pandemics and government measures.
3. In the event of force majeure, Knalveilingen.com may suspend its obligations or terminate the agreement without liability for damages.

Article 17. Privacy

1. Knalveilingen.com processes personal data in accordance with the GDPR.
2. Data is used for the performance of agreements, payments and communication.
3. Personal data is not kept longer than necessary.
4. Users have the right to access, correct and delete their data.

Article 18. Intellectual property

1. All rights to the website, software, texts and content belong to Knalveilingen.com or its licensors.
2. It is not permitted to copy, distribute or commercially use content without permission.
3. Infringement may result in legal action and a claim for damages.

Article 19. Amendments to these terms

Knalveilingen.com may amend these terms and conditions. An amended version will be published on this page, stating the effective date.

For ongoing bids and agreements, the version that applied at the time of bidding or purchase remains in effect; new terms apply from the stated effective date for new transactions.

Article 21. Governing law and disputes

1. Dutch law applies to all agreements.
2. Disputes will be submitted to the competent court in the Netherlands.
3. The parties will first attempt to resolve disputes by mutual consultation.

Article 22. Relationship to Partner Agreements

1. Affiliated partners (Sellers) offering products via the Platform are, in addition to these terms and conditions, also bound by an individual Partner Agreement with Knalveilingen.com, which sets out, among other things, commission percentages, payout terms, minimum supply requirements and any exclusivity arrangements.
2. These terms and conditions apply in full to all users, including partners, and apply in addition to the Partner Agreement.
3. To the extent a provision in the Partner Agreement deviates from these terms and conditions, the Partner Agreement between Knalveilingen.com and the relevant partner prevails on that specific subject; for all other subjects — including platform use, the auction process, fraud and misuse, privacy and governing law — these terms and conditions remain fully in effect.

Article 23. Final provisions

If any provision of these terms is found to be null or voidable, this does not affect the validity of the remaining provisions. The parties will replace the invalid provision with a provision that most closely approximates the original intent.
